1. Using GameTab
These Terms of Service form a legally binding agreement between you and Nexavyn (ABN: 21 696 400 476) ("GameTab", "we", "us") for your use of the GameTab app and related services. By creating an account, browsing the app, or using any feature, you agree to these terms and to our Privacy Policy. If you do not agree, do not use GameTab.
These product terms apply alongside the Nexavyn Terms of Service. If there is any inconsistency about GameTab, these product terms prevail.
2. Eligibility and Your Account
You must be at least 16 years old to use GameTab. You are responsible for keeping your account details accurate and your login credentials secure, and for activity you authorise through your account. You are not automatically responsible for unauthorised activity caused by a failure of our security or circumstances outside your reasonable control. Optional multi-factor authentication is available in Settings and we recommend enabling it. Notify us promptly at support.gametab@nexavyn.com if you believe your account has been accessed without authorisation.
Edit Profile lets you optionally select Male, Female, or Prefer not to say. You are not required to make a selection at all: leaving it unanswered has the same effect as choosing Prefer not to say. Your choice personalises artwork on your own Home screen and is shared with the admin team of each group you belong to, to help them organise games, tournaments and group activities, as described in the Privacy Policy.
You represent that you are not located in a country subject to a comprehensive trade sanction, and are not on any Australian, United Nations, or United States government list of sanctioned or restricted persons or entities.
3. Service Scope
GameTab is an organisational tool: it helps users create and join sports groups, schedule games, run tournaments, track participation and scores, communicate with members, and use admin tools where available. We may reasonably change features to improve the service or address technical, safety, legal or commercial needs. Material changes to paid features are subject to the notice and consumer-rights protections in Sections 9, 11 and 16. Some improvements are delivered as automatic over-the-air updates to the app.
4. Acceptable Use
You agree to use GameTab lawfully and respectfully. This applies to everything you submit — including group chat, game chat, direct messages, announcements, comments, polls, profiles, and group content. You must not:
- Harass, bully, threaten, or intimidate other users.
- Upload unlawful, abusive, hateful, violent, sexual, or misleading content.
- Impersonate any person or misrepresent your affiliation with any group or organisation.
- Send spam or unsolicited promotions, or misuse mention and notification features to disturb other users.
- Submit another person's personal information without their permission (see Section 7 on guests and member data).
- Upload images containing sensitive or confidential information (such as identity documents or financial details), or post such information in messages — some uploaded images can be viewed by anyone with their direct link, as described in the Privacy Policy.
- Post false, fraudulent, or misleading payment details, or otherwise use the group payment details or G-Credits features to deceive or defraud other members.
- Attempt unauthorised access to accounts, data, or systems, or circumvent security or moderation measures.
- Interfere with the operation, security, or integrity of the service.
5. Your Content, Moderation, and Reporting
You are solely responsible for content you submit, including profile information, group data, scores, polls, announcements, comments, chat and direct messages, and uploaded images. Messages and images are stored on our servers so they can be shown to the intended participants (retention periods are described in the Privacy Policy) — do not include sensitive personal, financial, or confidential information about yourself or others in messages or images. Profile photos, group covers and venue photos are stored in publicly linkable storage. Announcement images are stored in private storage and displayed using time-limited signed links; anyone with a valid signed link can view that image until the link expires. Do not upload sensitive information to publicly linkable images. Your responsibility for what you submit does not remove our obligations to handle personal information lawfully.
You retain ownership of your content, but grant GameTab a non-exclusive, worldwide, royalty-free licence to host, store, display, and process it as needed to provide the service, including through our service providers. This licence is limited to operating the service and handling safety, support and legally permitted retained records under the Privacy Policy; it does not permit using your identity or content in advertising without separate permission. It ends when the relevant content is deleted, except for the limited handling of retained copies described in that policy. Invite sharing is handled through your device share sheet, and GameTab does not read your personal contacts list.
Automatic language filter. Chat messages, direct messages, announcement comments, announcement titles and text, group names, descriptions and guidelines, profile bios, poll questions, options and admin responses, game titles and notes, tournament names and descriptions, and template names, titles and notes are checked automatically against a list of prohibited terms as you submit or change that text. Profile names are also checked, with exceptions for legitimate names and restrictions on impersonating official accounts. If your text matches, it is refused and you are asked to reword it — nothing is posted, and we do not keep a record of the refused attempt. This is a fixed keyword check, not a judgement about you, and it does not by itself restrict or penalise your account. Because it is a blunt word match it can occasionally refuse something innocent; reword and send again, or contact us if you think a term is wrong. Previously stored text is not automatically rewritten, and unrelated edits do not recheck unchanged text. Images are not filtered automatically and rely on reporting. How this works is described in the Privacy Policy.
Beyond that filter we do not pre-screen user content, but we may review, remove, hide, or restrict content that violates these terms. Group admins also have moderation tools within their groups (for example hiding reported comments, pinning messages, and removing members). You can report a message, comment, or announcement in the app, report a group from Explore or a user from their profile, or use More → Settings → Report Abuse for any unsafe content, including images. You can also contact support.gametab@nexavyn.com.
If you believe content on GameTab infringes your intellectual property rights, contact us at support.gametab@nexavyn.com with a description of the content, its location in the app, and your contact details. We will review the report and may remove or restrict access to the content.
Some content is automatically deleted over time (for example, chat messages after 90 days). If a message is reported, evidence is kept with the report for longer than the source content itself: a short excerpt for messages and comments, and the reported title, text and available image for announcements, so the moderation decision stays reviewable. Retention periods, including that exception, are described in the Privacy Policy.
Feedback. If you submit feedback, suggestions, or ideas about GameTab — including through the in-app Feedback form or in communications with us — you allow us to use the ideas and suggestions to improve and develop our services without paying you. Personal information, confidential support correspondence and safety reports remain subject to our Privacy Policy; this permission does not authorise publishing them or using your identity in marketing.
6. Platform Rights
The app, branding, design, software, and related assets are owned by GameTab or its licensors and protected by intellectual property laws. You are granted a limited, revocable, non-transferable, non-exclusive licence to use the app for its intended purpose — organising and participating in sports groups, including running groups under a paid Admin Plan and collecting session or membership fees from your own members as described in Section 7. What the licence does not permit is copying, selling, modifying, distributing, or sublicensing the app itself, or reselling access to GameTab to anyone else.
7. Groups, Credits, and Admin Responsibility
Group Admins
Every group has an Owner, and the Owner may also appoint one Co-admin and one Manager (together with the Owner, "admins" of that group). Only the Owner can delete the group, request a transfer of ownership, appoint or remove a Co-admin or Manager, and manage the group's Admin Plan billing. Ownership transfers are completed by GameTab support after both the current Owner and the new Owner confirm by email from the addresses on their accounts. The new Owner must already be a member of the group and hold an active Admin Plan with room for the group; from the transfer onwards the group runs on their plan. A new Owner may take over on their own free trial. Transfers are at GameTab's discretion: we may ask for more information, delay a transfer, or decline it. We normally transfer a group's ownership no more than once in any 12-month period, but will consider a genuine reason for another change, such as an Owner who can no longer run the group. The former Owner stays in the group as Co-admin, Manager or member, depending on which roles are free. Owners and Co-admins manage memberships, invitations, join requests, group blocks, skill assignments, private player ratings, scorer appointments and G-Credits. Managers help run games, tournaments, announcements and moderation, and can view member ratings and credit activity, but cannot manage those people-related permissions or add, deduct, or approve G-Credits. Group settings and payment details are Owner-only. A Co-admin or Manager uses the Owner's Admin Plan and does not need, and is not charged for, a subscription of their own. A group's admins are responsible for how they manage memberships, games, announcements, tournaments, and credits within their groups. Admins may see limited member contact details (such as a phone number provided with a join request) and agree to use member information only for organising and administering their group — not for marketing or any unrelated purpose.
Leaving a group or being removed ends access to that group's live content, but contributions to shared records may remain for their normal retention period. Historical games and completed or cancelled tournaments may remain available to their participants after a member leaves or a group is deleted. Before leaving a group, you must resolve games that have not ended, unfinished tournament commitments and G-Credit balances. Before deleting your account, you must resolve games that have not ended and outstanding G-Credit balances, and delete or transfer any groups you own. Unfinished tournaments do not block account deletion: affected entries are withdrawn automatically and retained tournament records have their direct account links removed. Only the group's Owner can delete the group itself — a Co-admin or Manager can leave normally without deleting or transferring anything first. The specific deletion and retention outcomes are described in the Privacy Policy.
Guest Players
Admins may add guest players by name. By adding a guest, you confirm they are at least 16 and you have their permission to record and share their name with game participants. Explain that their name forms part of the game record and direct them to our Privacy Policy and support contact. Record only the information needed for participation.
G-Credits
In-app credits ("G-Credits") are a record-keeping tool that group admins use to track participation entitlements within their group. Credits are managed entirely by group admins, not by GameTab. What a credit represents, how credits are earned, spent, or topped up, and any related payment arrangement is a matter of mutual understanding between each member and their group's admins. The group's Owner or Co-admin may, at their discretion, add, deduct, or adjust a member's credits — including applying deductions or penalties under their group's own rules (for example, for late arrival or no-shows). A Manager can view credit activity but cannot add, deduct, or approve credits. Credits are recorded in whole numbers only; fractional amounts cannot be entered. When an admin uses the app to split a total across several members, any share that does not divide evenly is rounded up to the next whole credit, so the combined amount can be slightly more than the total entered.
Credits are not legal tender and have no cash redemption value with GameTab; they cannot be redeemed, exchanged, or transferred for cash through GameTab. They may record an entitlement connected with a payment you made separately to a group organiser; these terms do not remove any rights you have concerning that separate payment. Any real-money arrangement between members and group admins (for example, paying an admin for court hire or to top up credits) happens outside GameTab, is solely between you and the admin you deal with, and GameTab is not a party to, and does not process, guarantee, or mediate, those payments. GameTab never collects money from group members. Our only charges are the Admin Plan fees billed to the group's Owner under Section 9. Any dispute about credit balances, adjustments, penalties, or related payments is between the member and the group's admins; the credit transaction history in the app exists to support that transparency, but GameTab does not arbitrate such disputes.
Payment Details
Only a group's Owner may add or change payment details (such as a PayID, BSB and account number, or similar) to the group's info page, visible only to current members of that group, so members know how to pay membership or session fees directly. As with G-Credits, any payment made using these details happens directly between the member and whichever admin collects it, outside GameTab — we do not process, verify, guarantee, or mediate it, and cannot confirm that the payment details are correct. Verify the recipient independently before paying. This does not exclude responsibility for our own conduct or any non-excludable legal obligation.
Leaving and closing groups: where offered, leaving with a positive G-Credit balance requires your explicit agreement to forfeit the displayed balance; a negative balance or pending credit request must first be resolved. An Owner may close a group with an explicit acknowledgement that remaining balances will be set to zero and recorded in the ledger, including after the Owner's plan expires. This is a record adjustment, not a payment or refund, and does not by itself settle any separate real-money obligation. Owners must resolve payments with affected members and use group information only for authorised purposes. Group payment and contact text can remain when ownership changes or its author deletes an account; review and remove outdated details before transfer and contact support if you cannot do so.
8. Physical Activity and Assumption of Risk
GameTab is a scheduling and communication tool only. We do not organise, host, supervise, or control any game, tournament, venue, or event arranged through the app, and we do not vet participants, venues, or equipment.
Participation in sport involves inherent risks, including the risk of injury. You are responsible for assessing your own fitness and ability to participate, for your own safety and conduct at events, and for complying with venue rules. To the maximum extent permitted by law (including the Australian Consumer Law), GameTab is not responsible for injuries, loss, or damage arising at or from games or events arranged through the app, or for the acts or omissions of other participants, group admins, or venues.
9. Paid Plans and Billing
GameTab's core member features are free — GameTab never charges group members. Group management features require the paid Admin Plan, billed only to the Owner of a group. A Co-admin or Manager appointed to help run a group uses the Owner's Admin Plan and is never separately charged. Admin Plan billing works as follows:
- Free trial: A new group Owner may receive a one-time free trial (duration shown in the app). No payment details are required to start the trial, and you can let it lapse without charge. The trial is available once per account. During the trial you get the full Admin feature set, including Plus features such as tournaments, with unlimited members and up to three groups; when it ends, continuing requires a paid plan sized to what you have built. The trial is for a new Owner to try GameTab. Using the trials of several accounts to keep the same group running without a paid plan, whether by passing ownership between members or by moving the members to a newly created group, is not permitted. If we find this, we may decline further ownership transfers, end the trials involved, or require a paid plan for the group to continue.
- Fixed monthly plans: The Admin Plan is offered as a set of monthly plans, and each plan is available in a Standard and a Plus version at different prices. Both versions of a given plan cover the same number of members and the same number of groups — Plus does not increase your capacity, it unlocks additional features on top of Standard, currently tournaments (see below). The price of each version is clearly displayed in the app before you subscribe. Your member count is the number of unique members across all groups you own, including your own account. The same person is counted once even if they belong to several of your groups. Guest players are not counted. Your group count is the number of groups in which you are the Owner; groups where you are a Co-admin, Manager, or ordinary member are not counted.
- Tournaments require Plus: Running tournaments requires the Plus version of your Admin Plan. They are included at no extra cost during your free trial, as described above; once the trial ends, continuing to run tournaments requires a Plus plan. Tournament features are currently available for badminton groups only. If none of your groups play badminton, Plus will not give you anything beyond Standard yet. We will tell you in the app before you subscribe, but please check this applies to you.
- Payment: Subscriptions are purchased and charged through your Apple App Store or Google Play account, under that store's terms. Payment is taken by the store, not by GameTab, and renews automatically each month until cancelled. Receipts and payment history are held in your store account.
- Upgrades and downgrades: When you change your paid plan through GameTab on Android or iOS, an upgrade takes effect immediately after the store confirms it. A downgrade takes effect at your next renewal: your current plan and its features remain active until then, and the selected plan and its recurring price apply from that renewal. Plans are ranked by member capacity, with Plus above Standard at the same capacity. Moving to a larger Standard plan from a smaller Plus plan is an upgrade in capacity, but removes tournament access when the change takes effect. Moving from Plus to Standard at the same capacity is a downgrade. Once Standard takes effect, you cannot create tournaments or enter further scores, including in tournaments already scheduled.
- Payment when changing plans: On an Android upgrade, Google Play applies the unused value of your current plan as time on the new plan and adjusts the next billing date. On an iOS upgrade, Apple charges for the new plan and refunds the unused portion of the previous subscription. For a downgrade on either platform, the new recurring price starts at the next renewal. Review the store confirmation for the applicable price, payment and renewal details before confirming. A scheduled change does not itself activate the new plan; you can check its status in More → Billing. These arrangements do not limit any non-excludable consumer rights.
- Your plan is tied to your GameTab account: A subscription belongs to the GameTab account that bought it and cannot be moved to a different GameTab account, even when both are purchased through the same Apple or Google account. Restoring purchases recovers a plan for the account that owns it; it will not transfer one between accounts. This matters most if you delete your GameTab account and create a new one — the subscription keeps billing (see Deleting your account below) and the new account cannot use it, so cancel in your store settings first if you no longer want the plan. Transferring or deleting your groups does not cancel your Admin Plan either; cancel it in your App Store or Google Play settings if you no longer need it.
- Plan limits: Your plan's member limit and group limit are both firm limits. Once the member limit is reached you cannot invite a new member or approve a new join request, and once the group limit is reached you cannot create another group, until you move to a larger plan. Existing members and groups are never removed to make room, and people already in your groups are unaffected.
- Choosing a smaller plan: The app will not let you subscribe to a plan that is smaller than what you are already using — for example moving to a plan that covers fewer members than you currently have. You can reduce your members or groups first and then move down, or cancel instead. If your plan does end up over its limit — for example after changing plans directly in your App Store or Google Play settings, which we cannot intercept — nothing is interrupted for the remainder of the month you have paid for and nobody is removed, but you cannot add anyone or create groups during that time, and if you are still over the limit when your subscription renews, Admin tools are paused until you upgrade.
- Discounts: We may offer promotional pricing, discount codes, or complimentary access at our discretion; doing so does not create an obligation to do so again.
- Future price changes: We may change Admin Plan pricing (Standard or Plus), add plans, or change what each plan covers. Where a change affects an existing subscription we will give you at least 30 days' advance notice through the app or the email address linked to your account, and your store will additionally seek any consent it requires before charging a higher price. A changed price never applies retrospectively to a month already paid for. If you do not agree to a notified change, you may cancel before it takes effect without a cancellation fee.
- Cancellation: Because subscriptions are billed by the app stores, you cancel from your Apple App Store or Google Play subscription settings; the app links you there from More → Billing. Cancelling stops future renewals. You keep Admin tools for the remainder of the month you have already paid for, after which the groups you own are paused — their records are preserved so you can reactivate later. Members (and any Co-admin or Manager, whose tools pause along with yours since they use your plan) keep full access to games, history, credits and RSVPs for a 7-day grace period after that. If the plan is still not renewed by the end of the grace period, every not-yet-finished game in your groups has its roster cleared — anyone registered is removed and any credits they spent are refunded — and no one can join a game in that group until you renew. Game records remain subject to the Privacy Policy's retention periods. Renewing restores eligible access, but does not recreate cleared registrations or reverse credits already refunded; players must register again. Store refund requests are handled through Apple or Google. Nexavyn remains responsible for supplying GameTab and for any remedy we owe under applicable consumer law; contact us if the service has a fault or you need help pursuing a remedy. Store policies do not override those rights. Where a refund is granted, the access it paid for ends — if a subscription is refunded, the corresponding Admin tools stop straight away rather than continuing to the end of the refunded month. Nothing here limits rights that cannot be excluded under applicable law, including the Australian Consumer Law.
- Deleting your account: Deleting your GameTab account does not cancel a store subscription. You must cancel your Admin Plan subscription separately in your App Store or Google Play settings, or billing will continue.
10. Enforcement, Suspension, and Termination
Reporting and Blocking
GameTab carries content written by other users — group chat, game chat, direct messages, announcements, and comments. If you see something that breaches the Acceptable Use rules in Section 4, you can report it: press and hold a message, use the report action on a comment, or use the report action on an announcement, and choose a reason. Reporting an announcement covers the whole post, including its text and any attached image.
Reports go to the admins of the group the content belongs to. The admins reviewing your report can see your name, report reason and explanation. That includes group chat, game chat, announcements and comments, and direct messages, which are conversations with a group's admin team. Group admins can see reports about their own content, including an admin whose content you report. You can choose Report to GameTab in the report screen instead: only GameTab reviews that report, and the group's admins cannot see it or your name. If no group admin is available, the report is saved and you can choose Send to GameTab; it is not forwarded automatically. If a report is about one of a group's admins and you disagree with how it was handled, or nobody decides within 3 days, you can ask us to review it from My Reports in Settings. Our decision is final within GameTab. If you're in Australia and a complaint about serious online harm isn't resolved (for example cyberbullying of a child, adult cyber abuse, or intimate images shared without consent), you can report it to the eSafety Commissioner at esafety.gov.au/report. If someone is in immediate danger, call 000.
Group admins are asked to review reported content within 24 hours. Where a report is upheld, they can remove the content and remove the responsible member from their group. Reports are not sent to GameTab automatically, including when no group admin is available or a report is left undecided. GameTab reviews content reports when a member chooses Report to GameTab, explicitly requests an eligible escalation, or contacts us directly. You can also use Report abuse or unsafe content in Settings to report a user, profile, group, or image directly to GameTab, or contact us at support.gametab@nexavyn.com. We will act on serious or repeated breaches, including by restricting or removing the responsible account. We do not tolerate objectionable content or abusive users on GameTab.
You can also block any other user directly, from the same press-and-hold menu. Blocking hides that person's messages from you everywhere in the app and prevents the blocked admin from sending you direct messages. Admin-team conversations are shared: a member can still contact other unblocked admins, while an admin who blocks a member can no longer send to that member. If no unblocked admin remains, sending in that conversation is unavailable. You can also block someone from their member profile. Blocking does not remove either person from shared groups or games. The person you block is not told. You can see and undo your blocks at any time in More → Settings → Profile Privacy → Blocked Users. Blocking is a personal setting: it changes what you see, not what other members of your groups see.
Action We May Take
We may investigate suspected misuse and take action that is reasonably necessary and proportionate to protect users, the service, or third parties; enforce these terms; or comply with law. Depending on the nature, seriousness, and frequency of the conduct, action may include a warning, removing or restricting content, limiting access to particular features, temporarily suspending an account, or permanently terminating an account.
Your account may be suspended or terminated for a material or repeated breach of these terms or misuse of the app, including violating the Acceptable Use rules in Section 4, harassing or threatening users, fraud or deliberately false payment details, abusing group, credit, chat, notification, or payment-related features, attempting unauthorised access, evading a prior restriction, or creating a material security or safety risk.
Unless immediate action is reasonably necessary because of serious or repeated misconduct, suspected illegality or fraud, a security or safety risk, potential harm to another person, or a legal requirement, we will where reasonably practicable tell you the reason and give you a reasonable opportunity to respond or remedy the issue before permanent termination. We may temporarily restrict or suspend access while we investigate. If you believe an enforcement action was made in error, contact support.gametab@nexavyn.com and we will review the available information. Nothing in this section limits rights or remedies that cannot be excluded under applicable law.
You may stop using GameTab at any time and can permanently delete your account in the app (More → Settings → Danger Zone → Delete My Account). Deleting your account ends this agreement, subject to clauses that by their nature survive (such as content licences for retained records, billing obligations, disclaimers, and liability limits). What happens to your data on deletion — including limited records retained for the disclosed legal, safety and dispute-handling purposes — is described in the Privacy Policy.
11. Availability, Maintenance, and Discontinuation
GameTab is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted availability, complete accuracy, or compatibility with every device or third-party service. The app may be temporarily unavailable during maintenance.
We maintain routine automated server-side database backups for disaster recovery, but GameTab is not a data storage or archival service. We do not guarantee that any particular content can be recovered or restored, and backups are not available to restore content you or a group admin have deleted. In the rare event we must restore the service from a backup after a system failure, changes made after the backup point (typically up to 24 hours of activity) may be permanently lost. Keep your own copies of any information that is important to you.
Service discontinuation: Although we intend to maintain GameTab, we do not promise that the app or every feature will operate indefinitely. We may decide to stop maintaining, providing, or operating some or all of GameTab if continuing is no longer reasonably practicable or viable, including because of material commercial or resource constraints, technical limitations, security or safety risks, changes in law or regulatory requirements, loss of a necessary third-party service, insolvency, or another circumstance materially affecting our ability to provide the service.
Unless urgent action is reasonably necessary or the circumstances are outside our reasonable control, we will give affected users at least 30 days' advance notice through the app, the email address linked to their account, or a notice on the GameTab website before permanently discontinuing the whole service. During the notice period, you may stop using the service, delete your account, or request a copy of your personal data as described in the Privacy Policy. We will provide a reasonable opportunity to make an access request where technically and legally practicable, but GameTab is not an archival service and you should keep your own copies of information important to you.
If GameTab is permanently discontinued, access to the affected service will end on the stated date. Admin Plan charges will stop accruing when the relevant paid service ends. We will coordinate subscription closure with the app stores and explain any steps you must take in your store account. Refund requests for unused paid service may be processed through the store, but its policies do not replace any remedy we owe you under applicable law. We will then delete, de-identify, or retain personal information in accordance with the Privacy Policy and applicable law. Nothing in this section excludes any consumer guarantee, refund entitlement, or other right or remedy that cannot be excluded under applicable law.
12. Limitation of Liability
To the maximum extent permitted by law, GameTab and its service providers are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the app. Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law. Depending on the circumstances, those remedies may include rectification, cancellation, a refund or compensation.
13. Indemnification
To the extent permitted by law, you are responsible for reasonable losses and costs arising from third-party claims only to the extent caused by your unlawful content, deliberate misuse, or material breach of these terms, including knowingly submitting another person's information without permission. This does not make you responsible merely because you attended an event or because someone was injured. It excludes loss caused or contributed to by our negligence, breach of these terms, or unlawful conduct. We must take reasonable steps to minimise loss, notify you of a claim and give you a reasonable opportunity to respond before seeking reimbursement. Non-excludable consumer rights and remedies remain unaffected.
14. Third-Party Services and App Stores
GameTab relies on third-party services including app stores, authentication and database providers (Supabase), push notification services (Expo, Apple, Google), email delivery (Zoho Mail for sign-up confirmation and password-reset emails, and Resend for app-generated emails), subscription management (RevenueCat), address search (OpenStreetMap Nominatim), diagnostics, performance monitoring and session stability (Sentry), and AI-assisted diagnostic analysis (Anthropic). Those services are governed by their own terms and policies. The Privacy Policy describes the information shared with these providers.
Some GameTab features depend on these providers continuing to make their services available to us on reasonable terms. If a provider materially changes, restricts, or discontinues a service we rely on, we may reasonably modify, suspend, or discontinue the affected features, subject to the notice and consumer-remedy protections in Sections 9, 11 and 12.
Additional Terms for Apple App Store Users
If you downloaded GameTab from the Apple App Store, the following additional terms apply between you, us, and Apple, and take precedence over anything inconsistent elsewhere in these Terms for that download:
- Acknowledgement: These Terms are an agreement between you and us only, not Apple. Apple is not a party to these Terms and is not responsible for the app or its content.
- Scope of licence: Your licence to use the app is limited to a non-transferable licence to use it on any Apple-branded product that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions, including use by other accounts associated with the purchaser through Family Sharing, volume purchasing or Legacy Contacts where those rules permit it. This does not transfer a GameTab account or make an account-bound Admin Plan shareable unless the relevant subscription offering expressly supports that.
- Maintenance and support: We, not Apple, are solely responsible for providing any maintenance and support for the app, to the extent required under applicable law. Apple has no obligation to furnish any maintenance or support for the app.
- Warranty: In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the app to you, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to any warranty are our sole responsibility, not Apple's.
- Product claims: We, not Apple, are responsible for addressing any claims relating to the app or your possession and/or use of it, including product liability claims, any claim that the app fails to conform to an applicable legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.
- Intellectual property claims: In the event of any third-party claim that the app, or your possession and use of it, infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement, and discharge of any such claim.
- Legal compliance: You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist-supporting," and that you are not on any U.S. Government list of prohibited or restricted parties.
- Developer contact: Questions, complaints, or claims about the app should be directed to us at support.gametab@nexavyn.com, not to Apple.
- Third-party agreements: You must comply with applicable third-party terms when using the app, including your app-store and wireless-data agreements.
- Third-party beneficiary: You acknowledge that Apple and its subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance, Apple has the right to enforce these Terms against you as a third-party beneficiary.
If you downloaded GameTab from Google Play, Google is not a party to these terms, has no obligation to provide support or maintenance for the app, and is not responsible for addressing any claims relating to the app. Your use of Google Play is governed by Google's own terms.
15. Miscellaneous
Assignment. We may assign or transfer these terms, in whole or in part, in connection with a merger, acquisition, or sale of assets. A transfer will not reduce your accrued rights or our obligations to you, and we will notify affected users of a material change in provider. You may not assign your rights or obligations under these terms without our consent, which we will not unreasonably withhold.
No waiver. Our failure to enforce any provision of these terms is not a waiver of that provision or any other.
Force majeure. We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including internet or infrastructure outages, natural disasters, or government action, to the extent we could not reasonably prevent or mitigate the effects. This does not remove non-excludable consumer remedies.
Complaints and disputes. Contact support.gametab@nexavyn.com with the issue and the outcome you seek. We will review the relevant information and explain our response. You may still contact your state or territory consumer agency, an appropriate regulator, court or tribunal; contacting us first does not prevent urgent relief or limit a statutory right.
16. Governing Law and Updates
These terms are governed by the laws of Australia. Nothing in these terms excludes rights that cannot be excluded under Australian Consumer Law. If any provision of these terms is found invalid or unenforceable, the remaining provisions continue in full force.
We may update these terms from time to time. For material changes we will notify you in the app (which may include asking you to re-accept the terms) and update the "Last Updated" date above. We will give reasonable advance notice of material changes and their effective date, except where urgent legal, safety or security changes require shorter notice. Changes will not retrospectively remove accrued rights; price and plan changes follow Section 9. Where agreement is required, we will ask for it. You may stop using the service and cancel future renewals if you disagree, without losing any non-excludable remedy.
